2. Which legal route applies?
The applicable process depends on the legal basis for your request and the jurisdiction of the requesting authority. Please use the section below that applies to your request.
Catawiki B.V.
Catawiki B.V. is a company registered and based in the Netherlands and, as data controller, is responsible for handling requests and Orders relating to user and transaction information.
All requests should therefore be addressed to Catawiki B.V., even where the requesting authority is located in a country where Catawiki has a local entity or employees.
Requests addressed to local entities or individual employees cannot be processed, and no information will be disclosed in response to such requests.
Dutch law enforcement authorities
Authorities in the Netherlands exercising supervisory or investigative powers should submit a warrant, court order or other legally binding request compelling disclosure of the requested information.
Requests should also satisfy the requirements set out in Section 3.
Law enforcement authorities outside the Netherlands
Under Dutch law, Catawiki cannot provide a substantive response directly to requests from non-Dutch law enforcement authorities unless a directly applicable legal instrument provides otherwise.
Where applicable, requests should therefore be submitted through the appropriate legal mechanism, including:
- a European Investigation Order;
- a Mutual Legal Assistance Request under an applicable international agreement; or
- a Letter Rogatory.
Orders under Article 10 of the Digital Services Act
Catawiki will comply with valid Orders issued under Article 10 of the EU Digital Services Act by competent judicial or administrative authorities of an EU Member State, in accordance with applicable law.
Authorities issuing an Article 10 DSA Order should ensure that the Order:
- is submitted by email to the address listed in Section 4;
- identifies the issuing authority and includes a unique Order reference;
- clearly states the legal basis under EU or national law;
- specifies the requested data; and
- is also sent to the Netherlands' Digital Services Coordinator (Autoriteit Consument en Markt).
Catawiki will assess and respond to valid Orders promptly and in accordance with applicable law.
European Production Orders and European Preservation Orders
Catawiki B.V. will comply with European Production Orders and European Preservation Orders in accordance with the EU e-Evidence Regulation, provided that all conditions for issuing such an order are met and that none of the grounds for refusal ex article 12 e-Evidence Regulation apply. Catawiki B.V. will always await approval from the Dutch authorities before complying with a European Production or Preservation Order.
Judicial authorities issuing a European Production Order or European Preservation Order should ensure that the Order:
- is submitted through the European e-Justice system;
- identifies the type of Order;
- clearly states the legal basis under EU or national law;
- specifies the requested categories of data; and
- complies with all other applicable requirements of the EU e-Evidence Regulation.
Catawiki will assess and respond to European Production Orders and European Preservation Orders in accordance with the EU e-Evidence Regulation, including any applicable review procedures and grounds for refusal.
Catawiki will assess requests from administrative authorities, including data protection authorities and consumer protection authorities, and respond where appropriate in accordance with applicable law.
Where appropriate, we recommend routing requests through the relevant Dutch counterpart authority in line with applicable cooperation mechanisms.
Requests should also satisfy the requirements set out in Section 3.
3. What should your request contain?
To enable us to process your request efficiently, please include:
- the legal basis for the request, including the relevant legal provisions and a brief description of the investigation;
